This is the official file repository¹, calendaring² and information sharing web service for the New York City Asbestos Litigation (NYCAL). NYCAL.NET is a subscription based website service provided to all parties in the New York City asbestos litigation. Users will be required to sign up for a member subscription to access calendar and document content.

Part Emails

Please note that as of September 9, 2024, Judge Suzanne Adams has been assigned as the new Part 13/NYCAL judge. (She has also been assigned as the new Part 40/Trial Assignment Part judge.) However, all communications with the Part remain the same. Communications to the Part 13 clerk shall be sent to SFC-Part13-Clerk@nycourts.gov and communications directly to Judge Adams’ chambers shall be sent to SFC-Part40-Adjournments@nycourts.gov (for both Part 13 and Part 40 matters). Please do not send any communications to Judge Adams’ current IAS Part 39, as she will be transferring out of that Part.

FROM THE SPECIAL MASTER REGARDING MANDATORY SETTLEMENT CONFERENCES:


Happy New Year to all!

Please note that I will begin a mandatory pilot settlement conference program in the near future, beginning with current trial-set cases. Each plaintiff firm with trial-set cases — not currently including transferred cases not yet set for trial — should email me the case name, Index number, Cluster, trial date and a list of defense counsel with email contact information by no later than Friday January 5, 2024. Such information should be provided to me within 2 business days of future trial cases to be scheduled by Justice Silvera.

I plan to conduct these conferences by Zoom. Before we meet, plaintiff counsel must have communicated a settlement demand and defense counsel must have settlement authority at the conference. I will permit opt-outs if both plaintiff and defense counsel agree and advise me of such agreement by email. For now, I will not require Client/Carrier/National Coordinating Counsel participation in the conferences, but I reserve the right to direct such attendance if I decide it would be beneficial to the process.

This is a pilot program, and I reserve the right to modify the process as we move forward in consultation with Justice Silvera.

No trial or other case deadlines will be modified or extended due to the pendency of such settlement conferences.

As always, I am available to assist with settlement conferences of non-trial set cases should both plaintiff and defense counsel request that I do so.

MESSAGE FROM THE SPECIAL MASTER ON BEHALF OF JUSTICE SILVERA’S PART:


I have been asked by Justice Silvera’s Part to remind counsel to ensure that counsel are signed up for E-Track for all of your pending NYCAL cases. Scheduled conferences may not appear on the NYSCEF, and the Court notifies counsel of upcoming conferences and other court appearances through the E-Track platform. Apparently there have been some non-appearances for recent cases as counsel were not signed up on E-Track for notifications.
